"This is Alabama. We speak English."

The state of Alabama offers driver's license tests in Japanese, Korean, German, Arabic, Chinese, Farsi, French, Greek, Russian, Spanish, Thai, and Vietnamese. And ... not to forget: also in English.

This created a discussion: Tim James, a Republican candidate for Governor, says "that's 12 languages too many".

"This is Alabama. We speak English. If you want to live here, learn it. We're only giving that test in English if I'm Governor."

How this may impact the attraction of Alabama for foreign companies may be found out in the future. Regardless of his sentiments, foreign companies such as German owned Mercedes plant or the Thyssen-Krupp plant or Asian motor companies have created in Alabama a lot of jobs in the past years. According to the US Chamber of Commerce there are over 70,600 jobs - for persons from Alabama - created by foreign owned entities.

Question to Mr. James: does he want to get rid of the companies as well resulting in unemployment for over 70,000 persons?


3 hour flight delay in USA? At least now you can de-plane


According to today's NPR report, airline passengers in the United States now have an exit option as a result of prolonged delays on the tarmac.

Last November, we blogged about a European law that would provide refunds to European airline passengers in the event their flights were delayed more than 3 hours. (original story can be found here)

Passengers in the USA shouldn't get too excited, however, as the U.S. federal government has not decided to copy the European law.

Instead, airline passengers in the USA can be on the lookout for the new "tarmac rule." Airlines will now be required to give passengers the OPTION to exit the plane if it is still on tarmac for 3 hours after leaving the gate. In addition, beverages and snacks must be made available to passengers after 2 hours on the tarmac, and the lavatory must be operational.

If an airline fails to meet the deadline they can face hefty fines - to the tune of $27,500 per passenger.

stellt sich mir die Frage, ob wirklich Benedikt VI gemeint ist. Der um das Jahr 920 oder 930 - die genauen Angaben sind nicht bekannt, nur dass er 973 Papst wurde - geborene Papst Benedikt VI stammt aus Rom.

Daher wohl eher Benedikt der Sechzehnte (XVI). Römische Zahlen sind schon schwer...

Bin mal gespannt, wann das dort korrigiert wird...

Senators Introduce Bill to Cap Size of Financial Institutions

On April 21, 2010, five US senators introduced a new bill. The name of the new proposed "Act" is "The SAFE Banking Act of 2010".

The goal: to place a cap on the size of financial institutions and ensure that they retain sufficient resources to cover their losses.

More details can be found in the press release from Senator Sherrod Brown (D-OH). INterested in some background about the purpose? It is to stop threads!

“If we’re going to prevent big banks from putting our entire economy at risk, we need to place sensible size limits on our nation’s behemoth banks. We need to ensure that if banks gamble, they have the resources to cover their losses,” Brown said in the press release.

This is how it is scheduled to be done:

1. Imposing a 6% leverage limit for bank holding companies and certain non-bank financial institutions.

2. Reducing the maximum permitted amount of non-deposit liabilities to 2% of US gross domestic product (GDP) for banks and 3% of US GDP for non-bank institutions.

3. Placing a 10% cap on any bank holding company's share of total insured deposits in the US.

Flugausfälle durch Vulkanausbruch – die Rechte der Beteiligten

Seit heute, 21. April, wird in Deutschland wieder geflogen. Dennoch dauert es noch einige Tage, bis wieder alles "normal" ist.

Nachdem seit letzter Woche der Flugraum über den meisten europäischen Ländern lahmgelegt war, ist nun die Frage, welche Ersatzforderungen möglich sind. Dies betrifft auch Deutschland. An keinen deutschen Flughäfen durfte gestartet oder gelandet werden.

Die zuständigen Minister der EU rechtfertigen dies mit der zu hohen Gefahr für Maschine, Besatzung und Passagiere, da die Aschewolke die Triebwerke beschädigen und einen Absturz zur Folge haben könnte. Tausende Urlauber und Geschäftsreisende konnten ihre Reise nicht antreten oder sitzen am Flughafen in aller Welt fest.

Die Rechtslage der Beteiligten bestimmt sich in Deutschland nach den §§ 651a ff. BGB, die den Reisevertrag regeln.

Wir hatten hier auf diesem blog zu Flugverspätungen schon mal im November 2009 berichtet, es gab eine EU Entscheidung dazu, doch ist das wohl bei "höherer Gewalt" - wie einem Vulkanausbruch - nicht anwndbar.

German BaFin may file action against Goldman

The German government said April 17, 2010 that it is considering taking legal action against Goldman, Sachs & Co. for defrauding investors. The German newspaper Die Welt reports:

Die IKB konnte im Sommer 2007 nur mit staatlicher Milliardenhilfe gerettet werden. Berlin erwägt nun ebenfalls rechtliche Schritte gegen Goldman Sachs: „Die Finanzaufsicht Bafin wird ein Auskunftsersuchen an die SEC stellen“, sagte Regierungssprecher Ulrich Wilhelm der „Welt am Sonntag“.„Nach einer sorgfältigen Bewertung der Unterlagen werden wir rechtliche Schritte prüfen.“

Federal lawsuit against Health Care Reform filed

13 States are alleging that the federal health care and insurance bill passed by Congress in March 2010, and signed into law by President Barack Obama, is unconstitutional.

The main argument is that the new federal health care law far exceeds federal legal authority under Article I and the Tenth Amendment of the U.S. Constitution.

The states state that the health care reform law imposes an illegal tax penalty against a state's citizens and legal residents who do not have qualifying health care coverage. Such "illegal" tax may be an unlawful direct tax that violates Article I, sections 2 and 9 of the U.S. Constitution.

Toter wurde in US Kleinstadt zum Bürgermeister gewählt

Das klingt wie ein guter Hollywood Film ... es ist aber die Reality Form einer Protestwahl extrem: Aus Unmut über ihre Bürgermeisterin haben die Bewohner einer US-Kleinstadt im Bundesstaat Tennessee einen Verstorbenen zu ihrem neuen Oberhaupt bestimmt.

Der Kandidat Carl Robin Geary, Sr. starb vor ein paar Wochen an einem Herzinfarkt. Dennoch wählten ihn 268 Bürger in Tracy City, Tennessee bei der Bürgermeisterwahl. Demgegenüber ist Amtsinhaberin Barbara Brock mit nur 85 Stimmen richtig abgeschlagen... aber gleichwohl im Amt bestätigt.

watch out: Power of Attorney's law

On April 8, 2010, the New York State Assembly passed a bill which, if approved by the Senate and signed into law, would clarify changes made to New York's power of attorney laws in September 2009. While this firm does not practice law in New York, it is worth to take a close look as either similar laws may be enacted in the future in North Carolina or Georgia.

In September 2009, Title 15 of Article 5 New York's General Obligations Law was changed. Additional words were added to address a concern that individuals executing a power of attorney may not understand the full consequences of giving the power. There was a discussion about potential abuse and how this abuse could be limited. Under the new law a few aspects had to be met to be a valid power of attorney, including:

  • Inclusion of legends relating to the potential scope of authority that may be granted to the agent and fiduciary duties of the agent owed to the principal.
  • Manual signatures of the principal and agent.
  • Notarization of the manual signatures.
Corporations doing business were after the new law not certain, if these new rules will apply to them as well. Therefore this amendment has caused concern among many practitioners.

The new bill, if passed by the Senate, would add a new section, 5-1501(C), which lists the types of transactions that the September 2009 Amendments would not apply to. This will clarify some of these concerns.

noch sind H-1B Visa möglich

Ab April 2010 können wie jedes Jahr bei der Amerikanischen Einwanderungsbehörde (U.S. Citzen and Immigration Services) Anträge auf Erteilung eines H-1B Visums eingereicht werden. Besonders ist in diesem Jahr, dass die Quote für das kommende Fiscal Year 2011, welches am 1. Oktober 2010 beginnt, noch nicht ausgelastet ist. Das gab es seit vielen Jahren nicht mehr.

Ein solches H-1B Visum kann für all diejenigen beantragt werden, denen ein Job in den USA angeboten wurde, der einen Bachelorabschluss oder einen vergleichbaren Abschluss in der betreffenden Fachrichtung voraussetzt und die tatsächlich einen solchen Abschluss besitzen. Außerdem muss das in dieser Fachrichtung übliche Gehalt bezahlt werden.

In der ersten Woche sind bei der Behörde erst 13500 Anträge der möglichen 65000 eingegangen. Dies sind weit weniger als in den Jahren zuvor. Daher geht die Behörde davon aus, dass die Antragsdecke von 65000 Anträgen dieses Jahr erst sehr spät erreicht werden wird.

internships, travel etc. in Germany

I got an email today about what to consider when in Germany... well here is an excerpt of my reply. I welcome any comments, especially other great websites which may serve as a starting point to learn more about Germany.

So, here we go....

First of all: no worries, to be in Germany is safe, no more worrisome than in the US.

I trust your daughter read a few books about life in Germany as rules of for example what it means to be polite differ a little. There are many online resources available, e.g.http://www.getcustoms.com/2004GTC/index.html or http://www.german-business-etiquette.com/ or also the book by Ms. Stern "Strange German Ways".

Once your daughter is in town I would suggest to visit the German Cultural Center on Colony Square

She could meet students from Germany there who do an internship here in Atlanta or just dive in the other world, read books etc...

Travel in Germany is comparable safe as travel would be in the US, many persons use public transportation as their preferred means of travel.

Generally most of the youth in Germany will be fluent in English and open to offer assistance- if asked.

Netzneutral: Entscheidung gegen Comcast

Wie ist es mit der Netzneutralität heutzutage? Die Gretchenfrage des 21. Jahrhunderts?
Es betrifft nahezu jeden. In welchem Ausmass Bürger durch Datenschutzfragen mobilisiert werden können, ist ja aus dem Achtungserfolg der Piratenpartei bei der letzten Bundestagswahl bekannt.

Der Washington DC Court of Appeal hat am 06. April 2010, in der gegen die FCC entschieden. Verkürzt dargestellt, hatte die FCC Comcast untersagt, das Nutzungsverhalten seiner. Internetkunden zu protokollieren und bei Tauschbörsenaktivitäten ebendiesen die Leitung abzuklemmen. Stichworte Netzneutralität v. Urheberrechtsschutz

Diese Entscheidung fällt genau in die Zeit, in der das französische "Three-strike"-Model (Baseball, three strikes and you're out, drei Stufen, Schnellverfahren ohne Richter, Verdacht ausreichend, kein Rechtsmittel) und den nicht öffentlichen Acta-Verhandlungen in Wellington/Neuseeland auf massiven internationalen Widerstand gestoßen ist. Gegenstand dieser eigentlich als Handelsabkommen konzipierten Werkes sind pikanterweise eben auch Sanktionen wie Internetzugangssperren, Kappen von Bandbreite, Filterung und Überwachung des Datenverkehrs, Sperren von IP-Adressen, Haftung der Internetprovider bei Urheberrechtsverstößen ihrer Nutzer, etc.

Zusätzlich hat erst Anfang vergangener Woche eine Anhörung im Europaparlament zu den Acta-Verhandlungen stattgefunden...
